'info/LICENSE' not in info/files

This work around works if I do conda build.... BUT doesn't work with bdt build

it's not only that

You have to:

1. Create the symlink
2. Change the recipe to point to LICENSE instead of ../LICENSE

I wonder if we don’t have to say something like RECIPE_DIR for the location of the license file instead of .. have you tested that?

My point being that, it could be that our recipes are underspecified, in which case this is not a bug, but rather a feature of the package manager and may not be fixed.

Actually, reading the link you provided at the github open issue, it states: "The filename is relative to the source directory.". We are expressing it in terms of the "recipe" directory instead.
